A federal judge presiding over Mahmoud Khalil’s case ruled on Friday that the Trump administration can continue to detain the Columbia University activist.

Other student protesters have been arrested, but Khalil's detainment has become a flashpoint across the country for immigrants' free speech rights and pro-Palestinian activism in the U.S.

Khalil was arrested after Marco Rubio invoked a rarely used statute that allows him, as Secretary of State, to personally deport people he determines threaten U.S. foreign policy goals.

Mr. Khalil’s lawyers have said that Mr. Khalil participated in an internship at the U.N. agency through Columbia and considered it to be coursework rather than employment.

Judge Michael Farbiarz said the government cannot keep Khalil detained based on its accusation that he threatens U.S. foreign policy goals. But the judge gave the government time to appeal.
